StarHype Packages – Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the StarHype Packages provided by Alive Destiny Media (“ADM,” “we,” “us,” or “our”). By subscribing to any of the StarHype Packages (Star Hype Basic, Star Hype Plus, or Star Hype Pro), you (“Artist,” “you,” or “your”) agree to be bound by the following terms and conditions.

1. Acceptance of Terms

By subscribing to any StarHype package, you acknowledge that you have read, understood, and agree to abide by these Terms. These Terms apply to all subscribers, and any violation may result in the suspension or termination of services.

2. Service Packages

Each StarHype package (Basic, Plus, or Pro) offers distinct services as outlined on our website. You agree to choose the package that fits your needs and budget. ADM reserves the right to modify or update the offerings within each package, which will be communicated on the website.

3. Payment Terms

  • Upfront Payment: Full payment for your chosen package must be made in advance to ADM’s bank account before any services are provided. You will receive payment instructions upon subscription.
  • Pricing: All package prices are stated in Nigerian Naira (NGN). ADM reserves the right to modify prices, but any changes will not affect current subscriptions.
  • Refund Policy: Payments made for StarHype services are non-refundable unless otherwise specified by ADM due to non-delivery of promised services. Refund requests will be reviewed on a case-by-case basis.

4. Submission of Content

  • Music Files and Assets: The Artist must provide the necessary music files (in .wav or .mp3 format), album artwork, and other required materials in a timely manner after subscribing to a package. Failure to provide content may delay the service timeline.
  • Ownership and Rights: By submitting music and other related materials to ADM, you confirm that you own all necessary rights to the content or have secured all rights, licenses, or permissions from third parties as necessary.
  • Liability: You acknowledge that ADM is not liable for any copyright infringement or legal disputes that arise from the Artist’s use of third-party content.

5. Timeline and Delivery

  • Service Timeline: Delivery timelines may vary depending on the package and services selected. ADM will endeavor to meet agreed-upon deadlines, but delays may occur due to unforeseen circumstances.
  • Artist’s Responsibilities: The Artist must respond promptly to requests for additional information, approvals, or corrections to avoid delays.

6. Promotion and Distribution

  • Digital Distribution: ADM will distribute your music via the CD Baby platform and other affiliated services. While we ensure distribution to all major platforms, ADM is not responsible for any platform-specific delays or technical issues.
  • Internet Radio Airplay: If applicable to your package, airplay on internet radio stations is subject to station availability and approval.
  • Targeted Advertising and Promotions: ADM uses third-party tools (e.g., Show.co, Groover) for targeted advertising and influencer feedback. However, placement on playlists, stations, or platforms is not guaranteed, as these decisions are made by third-party platforms.

7. Modification and Upgrade

  • Upgrades: Artists can upgrade from one StarHype package to another at any time by paying the difference in package pricing. Service timelines will adjust accordingly.
  • Modifications to Services: ADM reserves the right to modify package features, service timelines, or associated tools if necessary due to changes in third-party services or platforms.

8. Intellectual Property

  • License to Use: By subscribing to a StarHype package, you grant ADM a non-exclusive, royalty-free license to use your music, album artwork, and promotional materials for the purpose of providing the services under your selected package.
  • Retention of Rights: The Artist retains full ownership of their music and all associated intellectual property unless otherwise agreed upon in writing.

9. Disclaimers and Limitation of Liability

  • No Guarantee of Success: ADM does not guarantee specific results (e.g., number of streams, airplay, or playlist placements). The effectiveness of promotions depends on various factors, including the quality of the content and market response.
  • Third-Party Services: ADM uses third-party services and platforms for distribution, promotion, and analytics. We are not responsible for the actions, terms, or performance of these third-party platforms.
  • Limitation of Liability: To the fullest extent permitted by law, ADM will not be liable for any indirect, incidental, or consequential damages arising from your subscription to a StarHype package.

10. Termination and Suspension

  • Termination by ADM: ADM reserves the right to terminate or suspend your subscription if you breach these Terms or engage in fraudulent activities. No refund will be issued if termination is due to a violation of these Terms.
  • Termination by Artist: You may cancel your subscription at any time; however, no refund will be provided for services that have already commenced.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes will be subject to the exclusive jurisdiction of the courts in Nigeria.

12. Changes to Terms

ADM reserves the right to modify or update these Terms at any time. Artists will be notified of any significant changes, and continued use of the services will constitute acceptance of the revised Terms.
